TERMS & CONDITIONS

These Service Terms and Conditions (these Terms and Conditions) are agreed to by and between Ontime air taxi LLC, a Mongolian entity located at Bluemon center, J.Sambuu Street 32, Khoroo 8, Sukhbaatar District, Ulaanbaatar 14200, Mongolia (OnTime Aviation) and the individual(s) or entity(ies) utilizing, purchasing and/or reserving Flights coordinated or arranged by OnTime Aviation referencing and/or incorporating these Terms and Conditions (Customer). OnTime Aviation and Customer may each be referred to herein individually as a Party and collectively, the Parties. These Terms and Conditions are a binding legal agreement between OnTime Aviation, on the one hand, and all individuals and/or entities who participate in the applicable Flight(s) (as defined below), on the other hand. If Customer is accepting these Terms and Conditions on behalf of a company, organization, or similar entity, Customer is accepting these Terms and Conditions for that entity and representing to OnTime Aviationthat Customer has the authority to bind such entity to these Terms and Conditions. If Customer is traveling with and/or paying for multiple travellers, Customers acceptance of these Terms and Conditions will be on behalf of Customer and all members of the traveling party. Upon request,OnTime Aviation will provide a copy of these Terms and Conditions to any member of the traveling party.
OnTime Aviation LLC (hereinafter OnTime Aviation, we, us, or our) is a registered air carrier providing scheduled and chartered helicopter transportation services. These Terms constitute a legally binding agreement between you and OnTime Aviation.
Right to modify Terms
Ontime Aviation reserves the right to modify any or all of the General Terms from time to time in its sole discretion.
Fare and Payment
The price, applicable currency, and available payment method for the Ontime Aviation Services you are purchasing will be set out during your booking process. Ontime Aviation reserves the right to modify the Flight fares at any time prior to receipt of payment for such Flight.
Flight Confirmation
Flights are not confirmed until full payment is received, and the customer receives a confirmation email from Ontime Aviation (Confirmation).
Luggage Policy
Customers are allowed one (1) carry-on per person per Flight. Ontime Aviation Luggage Policy located at https://www.OntimeAviation……… (the Luggage Policy) is hereby expressly incorporated herein. Ontime Aviation reserves the right to modify the Luggage Policy from time to time in its sole discretion.
Pet Policy
For your safety, your pets safety, and your co-fliers comfort, pets are not permitted on Ontime Aviation flights.
Cancellation and Change Policies
Ontime Aviations Cancellation and Change Policies located at https://www.OntimeAviation.mn …. (the Cancellation and Change Policies) are hereby expressly incorporated herein.
Late Passengers
Customers must arrive fifteen (15) minutes prior to their scheduled departure time. Flights may depart up to five (5) minutes ahead of their scheduled departure time due to circumstances including, but not limited to, weather, temporary flight restrictions, air traffic congestion, and pilot duty times. Neither Ontime Aviation nor any aircraft operators have an obligation to wait for late passengers. Refunds are not issued for missed flights.
Flight Delays and Reassignments
Ontime Aviation will use commercially reasonable efforts to notify the Customer of delays or cancellations. To minimize cancellations and delays due to reasons outside of Ontime Aviations control, Ontime Aviation may reassign the Customer to a different aircraft, which may include a change of airframe model. If Ontime Aviation has to move a Flight to a time earlier than the Customers scheduled departure due to reasons outside Ontime Aviations control, and the Customer is unable to make the new departure time, the Customer agrees to accept a refund.
Passenger Weight Limit
Helicopters have a maximum weight capacity and other restrictions that govern the balance of the aircraft and help to ensure the safety of all our passengers. The maximum weight limit per passenger is 120 kg. Passengers exceeding the weight limit will be required to purchase an additional seat. Refusal to Transport
Ontime Aviation and/or aircraft operators may refuse to transport or remove a passenger from an aircraft for any reason, including, but not limited to: failure to comply with these Terms and Conditions, the General Terms, or the aircraft operators instructions; disorderly, disruptive, abusive, or threatening conduct; appearance by the passenger that he/she is intoxicated or under the influence of alcohol or drugs; the appearance that a passenger is engaged in illegal activity; unauthorized photography in Ontime Aviation lounges or on flights. Refunds for Flights terminated under this Section will be determined on a case-by-case basis. If a refund is granted, such refund shall be the Customers sole recourse against Ontime Aviation.
Additional Fees
Pricing may not include unexpected or incidental costs, for which Customer may be responsible, including but not limited to (i) public holiday operations, (ii) extraordinary air fees, (iii) catering requests, (iv) ground transportation requests, and (v) excess baggage. Customer is responsible for all costs, including excessive cleaning, associated with any damage, stains, or extraordinary wear and tear caused by, or otherwise attributed to, Customer or Customers passengers on any Flight (Damage Fees). All Damage Fees will be charged from Customer.
Identification
Customer and each member of the traveling party must present government-issued photo identification before boarding; such identity document should match the name as it appears on the Confirmation. Failure to provide proper identification may result in (i) delay of boarding and departure, or (ii) or denial in boarding and forfeiture of amounts paid for the Flight. Customer is responsible for informing all passengers that prior to boarding the aircraft they must show at least one form of valid state/government issued photo identification to the Operator. Ontime Aviation is not liable for Carriers reasonable refusal to allow any passengers to board the aircraft who fails to provide appropriate identification.
Communications and Notices
All communications, including legal notices, sent to Ontime Aviation must be mailed to the address first set forth above. Any reasonable method of written communication to Customer shall be deemed adequate notice by Ontime Aviation.
Warranty Disclaimer
The services are provided on an as is and as available basis. Use of the services is at your own risk. To the maximum extent permitted by applicable law, the services are provided without warranties as to the reliability, timeliness, quality, suitability, availability, accuracy or completeness of the services, and Ontime Aviation hereby disclaims, to the maximum extent permitted by applicable law, all representations and warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, Ontime Aviation, its affiliates, and its operators do not warrant that the services will meet your requirements or expectations; that the services will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In addition, you may also have other rights that vary from one jurisdiction to another jurisdiction.
Additional Disclaimers
In providing Ontime Aviation services that include air transportation or ground transportation (transportation services), Ontime Aviation contracts with third party persons and/or entities that manage, maintain, and operate aircraft and/or vehicles operating and providing the transportation services (transportation providers). Ontime Aviation offers information and a method to obtain transportation services provided by third party transportation providers, but does not, and does not intend to, directly operate any transportation services or act in any way as a transportation provider and has no responsibility or liability for any transportation services provided to you by such third-parties. You acknowledge and understand that Ontime aviation does not monitor any transportation providers on-going compliance with any and all licensing and/or permitting rules and regulations, and Ontime Aviation will not be responsible for any liability, claims, or damages arising from or in any way related to a transportation providers failure to maintain a current license and/or permit. Ontime Aviation disclaims any and all responsibility for the decisions you make regarding your use of the services. Ontime Aviation does not provide, nor does it maintain, liability insurance coverage, or any other insurance that extends or is intended to provide any coverage, protection, or benefit to you before, during, or after any flight you may purchase.
Assumption of Risk, Waiver and Release of Liability
Customer acknowledges (for themselves and any participant(s)) that transportation services are entirely optional and voluntary and that customer acknowledges (for themselves and any participant(s)) have freely elected to participate notwithstanding the potential risks involved, known and unknown, including serious injury or death. Transportation Providers shall be solely responsible for all claims and/or disputes arising out of any and all occurrences, accidents or incidents that occur on or in connection with the Transportation Services provided by Transportation Providers, including without limitation, property damage, bodily injury, and/or death. Ontime Aviation will not be a party to any claims or disputes between you and any Transportation Provider; however, Ontime Aviation reserves the right, but has no obligation, to monitor such claims and/or disputes.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Ontime Aviation, its affiliates, agents and/or employees be liable to you for any claims, liabilities or damages hereunder in an amount exceeding the amount paid by you to Ontime Aviation during the twelve (12) month preceding the event giving rise to the claim, or the duration of your use of the service, whichever is shorter.
Indemnification
You agree at your own expense, to indemnify, defend, and hold harmless Ontime Aviation and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys fees) incurred in, arising out of or in any way related to: (i) your breach of the Agreement; (ii) your use of or access to the Services; (iii) any dispute between you and any Transportation Provider related to your use of the Services; or (iv) your violation of any applicable law, rule or regulation; and (v) your negligence or wilful misconduct.
Other
Customer agrees that Ontime Aviation has no responsibility to book hotels or provide any other accommodations.
Governing Law
The laws of Mongolia govern this Agreement. Your use of the Service may also be subject to international laws.
